Tuesday at Vogler's Main Street Chapel. ABC Says Justices Will Allow Newsmen's Opinions to Be Probed By Richard Carelli WASHINGTON (AP) The Supreme Court will rule soon that public officials suing for libel may force journalists to tell what their thoughts, opinions and conclusions were while they prepared news stories, ABC reported Monday. The television network, in its evening broadcast, reported that the court already has decided an important freepress controversy, that could revolutionize law. The decision will be a defeat for the news media, ABC's report said. The high court heard arguments last October in a case involving a still-pending $44.7 million suit by former Army Lt.
Col. Anthony Herbert against CBS and others. A lower federal court had ruled that reporters and editors sued for libel do not have to disclose the kind of information Herbert was. seeking. But, according to ABC, the Supreme Court will reverse the ruling of the U.S.
Circuit Court of Appeals for the 2nd Circuit, which had said that the answers Herbert sought "strike at the very heart of the vital human component of the editorial process." Supreme Court spokesman Barrett McGurn offered "no comment" about the ABC report. Other court employees were stunned by the report, which, if accurate, would represent one of the few times in history that a decision reached by the justices during their secret conferences has been publicized prematurely. The ABC report, by reporter Tim O'Brien, said Justice Byron R. White was writing the court's majority opinion. It said Justice William H.
Rehnquist was joining White. The report, which did not offer a breakdown of how the nine justices voted, said Justice John Paul Stevens had attempted during the court's secret conference to dissuade White and Rehnquist. Circuit Court Judge Biggs Dies at 83 WILMINGTON, Del. (AP) Senior U.S. Circuit Court Judge John Biggs a man whom the late Chief Justice Earl Warren once called "a one-man ministry of justice," is dead at the age of 83. Biggs, who suffered a heart attack and stroke several weeks ago, died Sunday at a hospital here. He had remained active as a senior judge after stepping down as chief judge of the 3rd U.S.
Circuit Court of Appeals in Philadelphia in 1965. Delaware is included in the circuit. President Franklin D. Roosevelt appointed Biggs to the appeals court in 1937, and he was elevated to chief judge four years later. Among his most noted decisions, Biggs ordered the complete desegregation of Delaware's public schools, reversing a state court's opinion that permitted desegregation at the rate of only one class a year.
He handed down a ruling 1 that compulsory, Bible reading in public schools was contrary to the U.S. Constitution; and he ruled that Delaware's separate-but-equal doctrine in the public schools was discriminatory. In 1949, he was threatened with impeachment by a congressman from Georgia when he refused to extradite a black man who had fled from Georgia to Pennsylvania. Biggs said he would not permit the return of a man to a state where he had been treated cruelly and inhumanely. Private services are scheduled at Biggs' home and burial will be in the Bethel Cemetery near Middletown.

(AP) The worst Pearl River flood in history surged deeper into the heart of Jackson on Monday, sending water to the eaves of some homes in the suburbs and forcing officials to seal off the downtown area. With about 17,000 persons already driven from their homes, the river poured over sandbag levees and inundated more houses, businesses and public facilties, including the city's new $48 million sewage-treatment plant. Late Monday, President Carter declared the state a federal disaster area, meaning flood victims will become eligible for temporary federal housing and low-interest loans to repair homes and businesses. Mayor Dale Danks ordered police to seal off downtown as workers battled to keep floodwater from knocking out a key electric substation supplying power to the area.
Businesses closed, and police turned away all but non-essential workers to prevent sightseers from interfering with emergency operations and dump trucks bringing in dirt for sandbags. The levees were holding, but the water surged over the top in spots as the Pearl reached almost 43 feet at Jackson, nearly 25 feet above flood stage and well above the previous record of 37.5 feet set in 1902. Officials said the river could crest at 43 feet sometime Monday night. "We think the peak will come pretty soon," said Dave Waite, a city spokesman. "We're praying that's the Flooding followed the winding course of the river on Jackson's east side.
It has sent floodwaters up to the ceilings of expensive homes in northeast residential areas, shops, overflowing pushing into shopping downtown centers streets and spreading over low-lying areas in the southern part of city. Schools were closed indefinitely and were turned into emergency shelters. City officials said the flooding had driven more than 17,000 people from their homes in Jackson, but civil defense authorities put the number of displaced people at 15,000 statewide. Mayor Danks said the city was receiving about half its normal water supply because main pumps had flooded and emergency pumps were unable to maintain the volume. Authorities closed north-south Interstate 55 through Jackson on Sunday when sections were covered by floodwater.
Interstate 20, an east -west highway, was open, but police prevented motorists from using downtown exits, creating a Monday morning traffic jam that lasted several hours. The downtown area could be reached by only two routes, both from the north. 6 Drown in State Over Weekend By The Associated Press Six people drowned in North Carolina during the long Easter holiday weekend.
